Jeff Bucholtz is a partner in the National Appellate Practice on King & Spalding’s Business Litigation team.  Mr. Bucholtz joined the firm in 2009 after serving more than six years in leadership positions in the Civil Division of the U.S. Department of Justice, including six months as Acting Assistant Attorney General. Mr. Bucholtz has argued more than 25 appeals in the U.S. Supreme Court, most of the federal circuit courts of appeals, and several state courts.  Mr. Bucholtz’s oral arguments include Millbrook v. United States in the Supreme Court, as amicus curiae appointed by the Court to support the judgment below after the government declined to defend the judgment; high-profile matters such as the Valerie Plame Wilson v. Libby, et al. civil case in the D.C. Circuit; several cases of substantial interest to the FDA, one of the Civil Division’s principal clients, such as Mylan v. FDAin the Fourth Circuit and Apotex v. FDA in the D.C. Circuit; and significant district court cases such as Brandon Mayfield v. US in the District of Oregon and Steven Hatfill v. Ashcroft in the District of Columbia. 

Mr. Bucholtz began his service at the Department in 2002 as the Deputy Assistant Attorney General responsible for the Torts Branch.  In January 2004, he also assumed the supervision of the Office of Consumer Litigation, which is responsible for much of the FDA’s and the FTC’s litigation.  In April 2006, he was promoted to Principal Deputy Assistant Attorney General, with broad supervisory responsibility for all operations of the Civil Division.  Mr. Bucholtz then served for six months as the Acting Assistant Attorney General for the Civil Division in 2007 and 2008.  With over 800 attorneys, the Civil Division is the largest litigating division in the Department.  The Division handles cases in trial and appellate courts across a wide range of subject areas, including False Claims Act enforcement; constitutional (Bivens) and common-law tort suits; national security cases; administrative law matters; FDA-related criminal prosecution and civil enforcement; and immigration law.

Mr. Bucholtz has been a frequent speaker on topics such as government enforcement relating to off-label promotion of prescription drugs before the Food and Drug Law Institute, the Biotechnology Industry Organization, the Center for Business Intelligence, the American Enterprise Institute, the American Health Lawyers Association, the American Bar Association, and the British Institute of International and Comparative Law.  Mr. Bucholtz also served as a member of the Advisory Committee on the Federal Rules of Civil Procedure from 2007 to 2008. 

Prior to his tenure at the Department of Justice, Mr. Bucholtz focused on appellate litigation as an associate with King & Spalding’s Litigation and Antitrust Practice Group. After graduating from Harvard Law School, Mr. Bucholtz clerked for U.S. District Judge Stephen V. Wilson in the Central District of California and for now-Associate Justice Samuel A. Alito, Jr. when Justice Alito was a U.S. Circuit Judge for the Third Circuit.
